Bringing Two Mountains Together

Neutral Third Party Mediation & Negotiation Services

Some private investigators and attorneys are skilled Mediators, and some are not. But the right experienced investigator can be a very integral tool in some cases and circumstances.

There are situations or cases where an attorney may suggest or employ the use of Mediation or Negotiation services through a uniquely experienced private investigator. Examples of mediation needs may be:

  1. The attorney is busy and wants to pass the tedious activities of mediation off to a trusted neutral party.
  2. The client or opposing attorney may be somebody they don’t want to really deal with, and so they pass that function off to a neutral party.
  3. The Mediator may have excellent trust-building and hand-holding talents that may be required on certain cases.
  4. The Mediator may have some particular legal and/or life experience in family law, business, dependancy, criminal, or other more refined applications (maybe high-tech, farm and ranch, educational, etc).
  5. Mediation on civil cases could be directly between the Plaintiff (injured party) and the Defendant (accused party)...but most are not, which is why there is a lawsuit. In these cases a direct relationship and trust must be built, many times between the Mediator and both parties. Attorneys, if involved, may bounce in and out for review until an agreement is reached.
  6. A criminal case MAY be civilly compromised, and again the Mediator will be the neutral negotiator for both sides (alleged victim and defendant) throughout the process until an agreement is reached, signed, and filed.

I have had Mediation cases where the process was completed by phone and email. I have had other cases where I have had to travel back and forth across the state with lots of hand-holding to get the agreement penned. Each case is a new and different animal and my job is not to “replace” the attorney, but to enhance the process.

Client Mediation:

I have had many attorneys who hand over terminally “grumpy” or “high needs” clients that they just don’t want to deal with. In this way I am the Mediator between the client and the attorney, acting more like a buffer or relationship manager…and no worries, it’s part of what I do!

Expertise:

My life path with 40+ years of in-the-weeds as well as corporate level sales and marketing has given me a wide range of people and situational experience. I also have experience in high level negotiations and was a trainer for the Kenexa (IBM) Next Generations Negotiating program. All of this, plus my passion for helping people through the legal system, with hundreds of cases under my belt, further makes me uniquely qualified, as a licensed investigator, to offer legal Mediation services. Whether the clients raise cattle or program software, I will create a trusted relationship with all sides and advocate fairly, effectively, and efficiently.

Bringing two stubborn mountains with opposing needs and wants together is never easy. But, it is always worth the effort.
